Welcome to Shape My Brand. By engaging with our services or purchasing our products, you (“Client” or “Customer”) agree to the following Terms & Conditions. These terms are intended to establish clarity, ensure transparency, and safeguard the interests of both parties.
Payment Terms
- All projects and orders require a 60% advance payment upfront at the time of confirmation.
- The remaining 40% balance must be paid in full before delivery of goods or services.
- No goods or services shall be delivered until the complete payment is received.
- For long-term or loyal clients, a maximum period of 14 days may be granted to complete the balance payment, subject to prior written approval.
Procurement of Goods & Services
- Shape My Brand operates with a strong network of trusted vendors and service providers across industries.
- Once an order is placed, Shape My Brand procures the required goods or services from these vendors for execution.
- While we carefully select and coordinate with our vendors, the responsibility for proper execution, quality, and timely delivery lies with the vendor.
Vendor Liability
- In the event of any damage, delay, defect, or error caused by a vendor, Shape My Brand shall not be held liable.
- Any product or service quality issues must be addressed with Shape My Brand first, and we will provide reasonable assistance in facilitating communication with the concerned vendor.
Customer Responsibility
- The customer is responsible for reviewing, verifying, and approving all samples, designs, and specifications before final confirmation of any product or service.
- Shape My Brand shall not be held liable for errors, discrepancies, or dissatisfaction arising from a customer’s failure to verify or clarify requirements prior to order confirmation.
- Customers must provide accurate details, instructions, and approvals in a timely manner to avoid project delays.
Delivery Conditions
- Delivery of goods or services will only be initiated once full payment is received (unless otherwise agreed for loyal customers under the 14-day extension).
- If a customer fails to make the required payment within the agreed timeline, Shape My Brand reserves the right to withhold delivery or cancel the order.
Limitations of Liability
Shape My Brand shall not be liable for:
- Errors, delays, or damages caused by vendors.
- Mistakes or oversights made by customers in providing inputs or verifying deliverables.
- Indirect, incidental, or consequential losses arising from the use of our products or services.
Our liability, if any, shall be limited strictly to the scope of services provided directly by Shape My Brand and not to third-party vendors or external factors.
Force Majeure
Shape My Brand shall not be responsible for delays or non-performance caused by events beyond our reasonable control, including natural disasters, strikes, vendor shutdowns, or regulatory restrictions.
Governing Law & Jurisdiction
These Terms & Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts located in Ghaziabad, Uttar Pradesh.
Acceptance of Terms
By placing an order with Shape My Brand, the customer acknowledges that they have read, understood, and agreed to these Terms & Conditions.
